    Introduction

    Two very well positioned grass paddocks having access off Snitterfield Road are to be offered for sale by public auction in two lots. Both back on to existing residential development on the south western edge of the village of Bearley. Much of the surrounding land has been put forward to Stratford upon Avon District Council after their 'Call for sites' and thus could have future potential. The village is located almost equidistant between Henley-in-Arden and Stratford-upon-Avon. Warwick, Leamington Spa and Solihull are all within easy driving distance, with J15 of the M42 motorway lying approximately 4 miles east.

    The parcels of land are located just off the A3400, within the village of Bearley which even has a railway station with trains south to Stratford-upon-Avon and north to Birmingham (Moor Street and Snow Hill) and west/southwards to Warwick and London (Marylebone).

    Accessed off a right of way, the well kept parcels of pastureland are bounded by a mixture of well established hawthorn roadside hedging and well kept post and wire fences. The larger parcel has a number of specimen trees planted within it, Oak, Hornbeam and Sweet Chestnut and could be further planted to provide perhaps an arboretum or used for horse/pony grazing or other recreational use. The land has open views south and westwards as mentioned above tucked away behind existing residential development.

    One lot is of an irregular shape, but has road frontage and extends to approximately 0.27 acres (0.109ha) the other rectangular and extends to approximately 0.82 acres (0.33ha). Small parcels of grazing land on the edge of local villages such as these, only rarely come onto the open market and, therefore, the auctioneers commend early inspection.

    Tenure and Possession
    Both parcels of land are freehold and vacant possession will be given upon completion, scheduled for 28 days after the auction, ie Tuesday 21st June 2022 (or earlier by mutual agreement). On the fall of the hammer the successful purchaser will be required to sign the auction contract and pay a 10% deposit (minimum £5,000) to the vendor’s solicitors, together with an administration fee of £500 plus VAT to the auctioneers, in the room, on the night.
    Rights of Way and Easements
    The land is subject to all rights of way and easements that may exist. Access to both Lots will be over the right of way (hatched brown on the plan) and between Points A-C for Lot 1 and A -B for lot 2
    Boundaries and Timber
    All growing timber is included in the sale. The ownership of boundaries (where known) is delineated by an inward facing “T” mark.
    Sporting and Mineral Rights
    Sporting and Mineral Rights where owned are included in the sale of the freehold.
    Development Uplift Clause
    Both parcels of land will be subject to an Uplift Clause should planning permission be granted for residential use.

All gates must be left as found, no litter left and no dogs whatsoever are allowed on the land as livestock may well be grazing upon it.

    Directions
    From Henley-in-Arden and the north take the A3400 south, go through Wootton Wawen and pass under the railway bridge at Bearley, bearing immediatelyt left into Snitterfield Road. Both parcels of land will be found on the right hand side after approximately 300 yards.

    From the M40, A46, Stratford-upon-Avon and the south take the A3400 north from the Bishopton Island and, after approximately 2 miles, turn right (signposted to Bearley) and follow the above directions, where the land will be found on the right hand side, as indicated by the 'Earles' auction sale board.     Conditions of Sale
    The property will, unless previously withdrawn, be sold subject to the Special and General Conditions of Sale, which have been settled by the Vendor’s Solicitor. These conditions may be inspected during the usual office hours at the offices of the vendor’s Solicitor mentioned in these sales particulars during the five days, exclusive of Saturday and Sunday, immediately before and exclusive of the day of the sale. The conditions may also be inspected in the Sale Room at the time of the sale but they will not then be read. The purchaser shall be deemed to bid on those terms whether he shall have inspected the Conditions or not.
    Money Laundering
    Money laundering regulations have been introduced by the government, affecting auctioneers, under the Proceeds of Crime Act 2002/Money Laundering Regulations 2007. To comply with this Act, we require all purchasers to pay the deposit by any of the following methods: Bank/Building Society Draft, Personal/Company Cheque. All purchasers will be required to provide proof of both their identity and current address and all parties intending to purchase any property must bring with them the following items: Full U.K. Passport or Photo Driving Licence (for identification), a recent Utility Bill, Council Tax Bill or Bank Statement (as proof of residential address).
